Use of your data for advertising purposes

In order to enable personalized marketing in social networks, we use so-called remarketing pixels on our technology. If you have an account with one of the social networks integrated in this way and are logged in at the time you visit our website, the pixel links your visit to your account. You can make further advertising settings in the respective social networks in your user profile.

We use re-targeting technologies. Your user behavior on our technology is analyzed so that we can subsequently display advertising tailored to your interests on partner websites. Your user behavior is recorded in a pseudonymized form. Most re-targeting technologies work with cookies.

You can prevent re-targeting at any time by rejecting or disabling the relevant cookies in your web browser’s menu bar. In addition, you can request an opt-out from the advertising and re-targeting tools mentioned via the Digital Advertising Alliance website.

The following remarketing pixels are used on our technology:

AddThis

This website contains “AddThis” plugins that allow you to set bookmarks or share interesting website content. When using “AddThis,” cookies are used. The data generated in this process (such as the time of use or browser language) is transmitted to AddThis LLC, 1595 Spring Hill Rd, Suite …

You can object to the use of your data at any time by using an opt-out cookie (see more details below).

AdWords and DoubleClick

We use Google AdWords Remarketing and DoubleClick by Google, services provided by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland (registration number: 368047), to display advertisements based on the use of previously visited websites. For this purpose, Google uses the so-called DoubleClick cookie, which enables your browser to be recognized when you visit other websites. The information generated by the cookie about your visit to this technology (including your IP address) is transmitted to a Google server in the USA and stored there (for transfers of personal data to the USA, see the section below “Transfer of Personal Data Abroad” for additional information).

Google will use this information to evaluate your use of the technology with regard to the advertisements to be displayed, to compile reports on website activity and advertisements for website operators, and to provide other services related to website usage and internet usage. Google may also transfer this information to third parties if required to do so by law or if third parties process this data on behalf of Google. However, Google will not combine your IP address with any other data held by Google.

Disclosure of Data to Third Parties

We disclose your personal data if you have expressly consented to this, if there is a legal obligation to do so, or if it is necessary for the enforcement of our rights, in particular for the enforcement of claims arising from the relationship between you and Bergbahnen Destination Gstaad AG (e.g. debt collection agencies, authorities or lawyers). We may also disclose your data to third parties where this is necessary in connection with the use of the technology in order to provide the services you have requested (e.g. outsourcing partners, hosting providers, companies with which we offer services on our technology such as booking or purchasing services, and companies that conduct advertising on our behalf), as well as for the analysis of your user behaviour. When transferring data to third parties, we ensure through appropriate contractual guarantees that such third parties process personal data in accordance with applicable legal requirements and exclusively in our interest. If the technology contains links to third-party websites, Bergbahnen Destination Gstaad AG no longer has any influence over the collection, processing, storage or use of personal data by the respective third party once you click on such links and therefore assumes no responsibility for it.

Transfer of Personal Data Abroad

Bergbahnen Destination Gstaad AG is entitled to transfer your personal data to third-party companies (contracted service providers) abroad, provided that this is necessary for the data processing described in this privacy policy. These third parties are obliged to comply with data protection requirements to the same extent as we are. If the level of data protection in a country does not correspond to that of Switzerland or the European Union, we contractually ensure that the protection of your personal data always corresponds to that guaranteed in Switzerland or the EU. For the sake of completeness, we inform users residing or having their registered office in Switzerland that surveillance measures by US authorities exist in the United States that generally allow the storage of all personal data of individuals whose data has been transferred from Switzerland to the USA. This occurs without differentiation, limitation or exception based on the pursued objective and without any objective criteria that would make it possible to limit the access of US authorities to the data and their subsequent use to very specific and strictly limited purposes that would justify the interference associated with both the access to and the use of this data. Furthermore, we inform you that in the United States there are no legal remedies available for data subjects from Switzerland that would allow them to gain access to their personal data and request correction or deletion, nor is there effective judicial protection against general access rights of US authorities. We explicitly inform affected persons of this legal and factual situation in order to enable them to make an informed decision regarding consent to the use of their data.

Users residing in a Member State of the European Union are informed that, from the perspective of the European Union, the United States does not provide an adequate level of data protection, among other reasons due to the issues described in this section. Where we have stated in this privacy policy that recipients of data (such as Google or Facebook) are based in the United States, we will ensure either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-US Privacy Shield that your data is protected by our partners at an appropriate level.

Data Collection

As a rule, we receive the personal data mentioned in section 7.2 directly from you or from the respective partners (in particular Ticketcorner, Yousty AG, and Gstaad-Saanenland Tourism).

We may also obtain publicly available information from media and the internet where appropriate in the specific case (e.g. in the context of an application process or a credit check).

Retention period

Data security

We implement appropriate technical and organizational security measures to protect the personal data we process against unauthorized access, misuse, manipulation, loss, or destruction. These measures include, in particular, IT and network security solutions, access restrictions, encryption of data carriers and data transmissions, as well as internal policies, training, and monitoring. Our security measures are continuously updated in line with the state of the art.

Personal data is stored in the applications and software solutions we use. If the servers used are located abroad, the relevant provisions of this Privacy Policy regarding cross-border data transfers apply.

We also take internal data protection very seriously. Our employees and the service providers we engage are obligated to maintain confidentiality and to comply with applicable data protection regulations. If third parties gain access to personal data in the context of data processing on our behalf, we ensure through appropriate contractual agreements that they also implement adequate technical and organizational security measures.

Cookies

We use cookies on our website. Cookies help make your visit to our website easier, more convenient, and more meaningful in many ways. Cookies are information files that your web browser automatically stores on your computer’s hard drive when you visit our website.

Session cookies are used to assign server-stored information to you or your internet browser during a specific visit to our website (e.g., in the online shop) each time you access it. This ensures, for example, that the contents of your shopping cart are not lost. Session cookies are deleted after you close your internet browser.

Persistent cookies are used to store your preferences (e.g., preferred language) across multiple independent visits to our website, including after you close your browser, or to enable automatic login. Persistent cookies are deleted in accordance with your browser settings (for example, one month after your last visit). By using our website and its corresponding functions (e.g., language selection or auto-login), you consent to the use of persistent cookies.

Cookies do not damage your computer’s hard drive and no personal data of users is transmitted to us through these cookies. We use cookies, for example, to better tailor the information, offers, and advertising displayed to you according to your individual interests. Their use does not result in us receiving any new personal data about you as an online visitor. Most internet browsers automatically accept cookies. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears when a new cookie is received. Disabling cookies may result in some features of our website not functioning properly.

You can prevent the storage of cookies by adjusting the settings of your browser software accordingly. However, please note that in this case you may not be able to fully use all the functions of this website.

In addition, you can prevent Google from collecting and processing the data generated by the cookie and related to your use of the website (including your IP address) by downloading and installing the browser plug-in provided by Google.

We use so-called tracking tools on our website. These tracking tools allow us to observe your browsing behavior on our website. This observation is carried out for the purpose of designing our website in line with users’ needs and continuously optimizing it. In this context, pseudonymized user profiles are created and small text files stored on your computer (“cookies”) are used.

Third-party providers may also use persistent cookies, pixel tags, or similar technologies for this purpose. The third-party provider does not receive personal data from us but may track your use of our website, combine this information with data from other websites you have visited that are also tracked by the third-party provider, and use these insights for its own purposes (e.g., to control advertising). The processing of your personal data by the third-party provider then takes place under the responsibility of that service provider and in accordance with its own privacy policies.

In such cases, we will only store your personal data or use it to protect our legal claims or the rights of another person. Provide you with your personal data in a structured, commonly used, and machine-readable format (right to data portability). To submit a request to exercise any of the rights described in this section, please contact a member of staff using the contact details provided at the beginning of this Privacy Policy. If we do not comply with a request, we will inform you of the reasons. For example, we may lawfully refuse deletion if your personal data is still required for the original purposes (e.g., if you continue to use one of our services), if the processing is based on a mandatory legal obligation (such as statutory accounting requirements), or if we have an overriding legitimate interest (for example, in the case of a legal dispute involving the data subject). If we assert an overriding legitimate interest in processing your personal data, you nevertheless have the right to object to the processing if your particular situation leads to a different balancing of interests compared with other affected persons (right to object). This may be the case, for example, if you are a person of public interest or if the processing could create a risk that you may be harmed by third parties. If you are not satisfied with our response to your request, you have the right to lodge a complaint with a competent supervisory authority, for example in your country of residence or at the registered office of Bergbahnen Destination Gstaad AG (right to lodge a complaint).
